By accessing or using TrueSmile ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TrueSmile is an AI-powered smile visualization platform designed for dental professionals. The Service allows users to upload patient photos and generate realistic smile transformation previews using artificial intelligence.

3. Account Registration

To use TrueSmile, you must create an account using a valid email address, phone number, or through Google or Apple sign-in. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Subscription Plans & Usage

TrueSmile offers multiple subscription tiers with varying monthly generation quotas. Details of available plans and pricing are displayed within the app. By subscribing, you agree to the associated fees and billing terms.

• Subscription fees are billed in advance on a monthly or annual basis
• Unused generations do not roll over to the next billing period
• You may cancel your subscription at any time; access continues through the end of the current billing period

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of professional regulations
• Upload photos without proper consent from the individuals depicted
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
• Share your account credentials or allow unauthorized access to your account
• Use the Service to generate misleading or deceptive content
• Circumvent usage limits or abuse the generation system

6. Patient Consent & Professional Responsibility

As a dental professional, you are solely responsible for obtaining appropriate informed consent from patients before capturing their photos and generating smile previews. You are also responsible for complying with all applicable healthcare regulations, including HIPAA where applicable.

7. Intellectual Property

The TrueSmile service, including its AI technology, user interface, and branding, is owned by TrueSmile and protected by intellectual property laws. You retain ownership of photos you upload. AI-generated smile previews are licensed to you for professional dental consultation use.

8. Disclaimers

AI-generated smile previews are visualizations for consultation purposes only. They are not guarantees of treatment outcomes. TrueSmile does not provide medical or dental advice. The Service is provided "as is" without warranties of any kind, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, TrueSmile shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting support. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
